January 20, 2025, Executive Order 14159

  • The order revokes prior executive orders related to immigration enforcement and policies from 2021. 
  • The Department of Homeland Security (DHS) is directed to prioritize enforcement of immigration laws to “protect the public safety and national security interests” of the U.S.
  • The Department of Justice (DOJ) and DHS are directed to prioritize the prosecution of criminal offenses related to “unauthorized entry” or “unauthorized presence” in the U.S.
  • DHS and DOJ are directed to establish “Homeland Security Task Forces” in every state to coordinate federal, state, and local law enforcement in immigration enforcement activities, which include combating criminal cartels, smuggling, and transnational criminal organizations.
  • DHS is directed to implement requirements ensuring noncitizens comply with federal registration obligations under the Immigration and Nationality Act (INA).
  • DHS and the Department of Treasury (DoT) is directed to assess and collect fines and penalties from noncitizens. 
  • DHS is directed to take action to allocate resources or establish contracts to “construct, operate, control, or use facilities to detain” removable noncitizens.

  • Executive Order directs reevaluation of designations of Temporary Protected Status (TPS) and employment authorization for any unauthorized noncitizen. 
  • DOJ and DHS are directed to make sure that jurisdictions with sanctuary policies do not receive federal funds and take criminal or civil actions against these jurisdictions.

  • DOJ, DHS, and the Department of Health and Human Services (HHS) are directed to focus on the “trafficking and smuggling” of noncitizen children. 
  • DOJ and DHS are directed to review and pause or terminate all agreements providing federal funding to non-governmental organizations supporting or providing services to removable noncitizens. 
  • DHS is directed to hire more agents and officers to carry out immigration enforcement activities subject to available appropriations.
