Stop Illegal ICE Detainers: Details on Enforcing the Gonzalez v ICE Class Action Settlement

In Gonzalez v. ICE, immigrant rights groups challenged ICE's practice of issuing detainers without a neutral review of whether they are based on probable cause. A final five-year settlement went into effect on March 4, 2025 that prevents ICE from issuing detainers that are not based on prior removal orders or pending proceedings. The settlement impacts detainers that ICE sends to 42 states and territories.
