Biden Administration Slams Door on Asylum Seekers with Asylum Ban Rule

(Washington)—On the eve of the cruel and needless Trump era Title 42 policy ending, the Biden Administration published a final asylum ban rule that will make most migrants ineligible for asylum when they reach the southern border. 
 
“The asylum ban rule essentially slams the door shut for asylum seekers,” said Policy Attorney and Strategist Elizabeth Taufa with the Immigrant Legal Resource Center (ILRC). “The administration has had two full years to come up with solutions to manage the border while also protecting the rights of asylum seekers. This rule puts the U.S. right back in Trump era immigration policies and the Biden Administration seems to have forgotten that two federal courts struck down Trump’s asylum ban as unlawful.” 
 
The asylum ban requires that people apply for asylum in the countries they cross through on their way to the U.S.  In a public comment regarding the transit ban, the ILRC detailed concerns with how this rule would essentially ban a large number of asylum-seekers from relief and how the rule impermissibly restricts the due process rights of asylum-seekers at the U.S.-Mexico border. 
 
“The Biden Administration has yet to be proactive in ensuring that humane, compassionate and lawful policies are enacted, and they must abandon the previous administration’s anti-immigrant agendas,” Taufa said.
