Temporary Protected Status (TPS): Current Designations and Employment Authorizations/Work Permits

Temporary Protected Status (TPS) is an immigration benefit that generally offers protection from deportation T and provides an employment authorization document (EAD), also known as a “work permit” or “EAD” to those that qualify. .

To be considered for TPS, individuals must be from a designated  country-specific and meet the applicable eligibility requirements for the particular designation, including the required date of residence and physical presence in the United States. TPS does not, by itself, provide a path to lawful permanent residence or citizenship, but a person may have other immigration options, depending on their individual circumstances.

What is the current status of TPS?

The TPS landscape has changed dramatically under the Trump administration. As of the date of this update, there are only four TPS designated countries left: El Salvador, Lebanon, Sudan, and Ukraine.

Understanding the status for designated TPS countries is especially important for TPS holders because employment authorization, and the validity period, is tied closely to the underlying TPS designation.

Because DHS has applied automatic extensions to certain TPS EADs based on when they were issued and not others, it is important to check and not assume that an EAD issued under a particular country’s TPS designation has the same validity date.

Current TPS Designations and Employment Authorization

The chart below summarizes the countries with TPS designations that remain in effect as of the date of this update. Because EAD validity can depend on the EAD's category, original expiration date, automatic-extension rules, and subsequent United States Citizenship and Immigration Services (USCIS) guidance, the chart should be used as a starting point rather than as a substitute for checking the applicable USCIS notice on the USCIS websites linked below.

What is happening with El Salvador TPS?

USCIS lists El Salvador's TPS designation as continuing through September 9, 2026. There is currently conflicting information in publicly available Department of Homeland Security (DHS) USCIS materials about the status of Salvadoran TPS after September 9, 2026, so Salvadoran TPS holders should check for updated USCIS guidance. However, the USCIS webpage states that Salvadoran TPS beneficiaries still have protection from detention and deportation and are eligible to work pending an announcement from DHS.

Can I work and drive if I am a Salvadoran TPS holder?

Yes, employers must continue to accept Salvadoran TPS EADs until DHS makes a formal announcement about the future of TPS for El Salvador. The National TPS Alliance has provided a letter for TPS holders from El Salvador to use in explaining their status to employers and the DMV which should be used jointly with the USCIS webpage announcement.

Frequently Asked Questions

My TPS EAD is expired, but I applied for renewal or fall under the automatic extension categories. How do I show my employer that I can work or to the DMV that I have status?

For El Salvador TPS holders, print the USCIS webpage with the alert stating that “Salvadoran individuals present in the U.S. under TPS retain protection including work authorization” and consider bringing the letter prepared by the National TPS Alliance.

For all other TPS holders, carry your expired TPS EAD card and bring the corresponding Federal Register Notice found on the USCIS webpages linked above as proof of your immigration status with your employer or the DMV.

How do I know if the TPS designation for a country is going to be extended or not?

Unfortunately, there is no way to know if a TPS designation for a country will be extended until it is formally announced by the government in the Federal Register and/or the USCIS TPS webpage.

What can I do to prepare for a potential termination?

We urge all TPS holders to seek legal advice from a trusted legal service provider about their rights and legal options. Make sure to keep copies of important immigration documents in a location accessible and known to a trusted person.
